These terms govern your use of FreshRig (the "Service"), operated by Shovelware ("we", "us"). By creating an account, subscribing, or using the Service you agree to them. If you don't agree, don't use the Service.
1. Independence — we are not the government
FreshRig is an independent commercial product. It is not affiliated with, endorsed by, or connected to the Federal Motor Carrier Safety Administration (FMCSA), the U.S. Department of Transportation (USDOT), or any government agency. We resell and present information that those agencies publish as public record. Nothing you receive from us is an official government communication, and no service we or our customers offer is required by FMCSA unless FMCSA itself says so.
2. What the Service provides
The Service surfaces and lets you filter and export motor-carrier registration records derived from the public FMCSA Company Census File and related public FMCSA datasets — including legal/DBA name, business address, phone, cell phone, email, fleet/operation attributes, and registration date. This information is published by FMCSA under the federal Open Data Policy.
3. Data accuracy — provided "as is"
Records originate from FMCSA and from carriers' own filings. We do not create, verify, or guarantee the accuracy, completeness, currency, or fitness of any record, and FMCSA data may lag, contain errors, or change. The Service and all data are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
4. Acceptable Use — your outreach is your responsibility
You are solely responsible for how you contact anyone whose information you obtain through the Service, and for complying with all applicable laws. In particular, you agree that you will not:
- Misrepresent affiliation. Do not state or imply that you are, or are endorsed by, FMCSA, USDOT, or any government agency, or that a product or service you offer is government-required when it is not. (FMCSA actively warns carriers about, and pursues, deceptive solicitation.)
- Violate calling/texting law. Comply with the Telephone Consumer Protection Act (TCPA), the National Do-Not-Call Registry, and state equivalents — especially for calls or SMS to cell-phone numbers and to sole proprietors, which may require consent.
- Violate email law. Comply with the CAN-SPAM Act — accurate headers and subject lines, a functioning opt-out, and a valid physical address in commercial email.
- Use the data for credit, insurance-underwriting, employment, tenant, or other decisions governed by the Fair Credit Reporting Act (FCRA). The Service is not a consumer reporting agency and the data is not a consumer report.
- Resell, redistribute, or sublicense the raw data or bulk exports, or build a competing data product from it.
- Scrape, hammer, or circumvent the Service's access controls, rate limits, or subscription gating, or share account credentials.
- Use the Service for any unlawful, harassing, fraudulent, or deceptive purpose.
Violation of this section is a material breach and we may suspend or terminate your account immediately, without refund.
5. Accounts
Sign-in is by emailed magic link. You are responsible for activity under your account and for keeping access to your email address secure. One account is for one organization's internal use.
6. Subscriptions, billing & cancellation
Paid plans are billed in advance on a recurring monthly basis (currently $99/month) via our payment processor, Stripe. Subscriptions renew automatically until cancelled. You can cancel anytime through the billing portal; cancellation stops future renewals and access continues until the end of the current paid period. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial periods. We may change pricing on prospective notice.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss arising from your use of the data or your outreach (including any TCPA/DNC/CAN-SPAM/FCRA claims against you). Our total liability for any claim relating to the Service is limited to the amount you paid us in the three (3) months before the claim. You agree to indemnify us against claims arising from your use of the Service or your violation of these terms or applicable law.
8. Privacy
We collect the email address you sign in with and standard operational/usage data, and we use Stripe to process payments (we do not store card details). We use this to operate the Service and do not sell your account information. The carrier records in the Service are public FMCSA business-registration data, not data we collected from you. If you are a carrier and want to understand or correct your FMCSA record, contact FMCSA directly. Email hello@shovelware.ai for privacy requests.
9. Changes & contact
We may update these terms; material changes take effect when posted here with a new "last updated" date, and continued use means acceptance. These terms are governed by the laws of the State of [STATE], USA, without regard to conflict-of-law rules. Questions: hello@shovelware.ai.
